    Mot help please

    Recommended one of my customers to a garage for an mot one I use from time to time just for my mot,s not bad guys !

    Question is the car a fiesta an old style one failed on front wheel bearing and brakes seized and imbalance back and front! Her existing mot runs out April 12 th the mot guy said the car is now illegal and the failed certificate overides the mot it still has . I thought what a load of crap or am I wrong ?? Her tax runs out this month so I said get down the post office quick and tax it he told her they would refuse to do it sounds like crap again or am I completely wrong and mot rules have changed??

    Not to my knowledge (is that spelt right?), i was lead to believe that it still has a current mot so you could still buy tax.
    He might be using it to scare her into having the work done, or confusing it with its not being roadworthy,

    Right or wrong the thing needs to be off the road. I thought the testers were in a position to put prohibition notices on cars if they thought that they were unroadworthy.

    Drives fine only done 2000 miles since last mot old car but not a wreck definitely not dangerous they quoted over £300 to sort it and then said she has 10 days to get it done or another mot charge ?

    I would say they are right. The car has a dangerous brake problem
    so it should not be on the road. Obviously the defects are recorded on the mot computer which is the dvla. so I would think the defect would show up on a police check if done. One other thing if the car was involved in a accident I would think the driver would be in the **** driving it while knowing its got a brake defect as this would be recorded.

    if it had a pass with days left on it then that still stands, a fail doesn't delete an existing certificate, a tester can only test a vehicle and advise the customer afterwards on the outcome, thats all, you have 10 working days to represent a vehicle for a retest that most garages don't charge for after that period its a full test again.

    /\ Ad Bill says, existing certificate is STILL valid despite the fail . Driving the car on the road in an unroadworthy condition is C&U offence, exactly the same as if caught driving an MOT exempt pre 1960, vehicle, it still has to meet C&U regs in use.

    False the old Mot is still ok
    Only two things can remove Mot ticket queen or m.o.s
    The only thing is she is now countable for her actions eg knowingly driving a vehicle in a unfit state
    It been that way since day dot never as been any difrant
    Only time was when a mot/vts long time ago could put a red fail unfit for road use but garages used it to there gaine

    A fail MoT does not over ride an existing MoT until it's expiry date. BUT given what it failed on you would be on very thin ice driving it in a known dangerous condition (it's recorded as such on the DVLA MoT database whether you agree or not) and get pulled/have an accident.
